SCHEDULE – I: DETAILED TERMS AND CONDITIONS FOR THE CASHBACK OFFER

1. This limited period offer (“Promotion”) is available for Indian citizens of age 18 years and above only. By participating in this promotion, you confirm to be at least 18 years of age.

2. The Promotion is only valid for the Customers (“Customers”) who purchase the Signutra Product (“Signutra Product”) from any of the dealer outlets (“Stores”) authorized by Win Medicare Private Limited (Health and Nutrition Division)(‘’Company’’) across India between 1st May, 2024 to 31st October, 2024 (both dates inclusive) (“Scheme Period”).

3. The eligible customers shall stand a chance to receive assured Cashback Coupon (“Voucher”), inside the Signutra Product purchased, which entitles the Customers to a Cashback (“Cashback”) in the form of a Amazon Pay or Phone Pe Code (the customer can choose any one) worth Rs. 100/- (“Cash Code”) as per the terms of the Promotion.

4. The services under this Promotion will be provided by a third party service provider Viz. Team Promotions Private Limited (“TPPL”). Hence, the liability for rendering appropriate services in this regard lies with TPPL only and the Company owes no responsibility for the quality of services being provided under this Promotion. The Customer shall submit all its claims/queries pertaining to this Promotion to TPPL alone and not to the Company.

5. The Customers intending to participate in the Promotion, who have listed their phone numbers on the National Do Not Call Registry (“NDNC Registry”), shall de-register themselves from the NDNC Registry till the completion of the Promotion (including the delivery of Cash Code (if applicable) under this Promotion). Such persons agree not to make any claim or raise any complaint whatsoever against the Company and/or TPPL in this respect. Please note that Customers intending to participate in the Promotion who have not de-registered themselves from the NDNC Registry shall also have no right to make any claim or raise any complaints against the Company, TPPL or any other agents of the Company if they do or do not receive any call/SMS with respect to their participation and all other matters pertaining to the Promotion.

6. To receive the Cash Code the Customers must follow the below written steps:

Step 1: Scan the QR code printed on the Voucher placed inside the Signutra Product purchased.

Step 2: The voucher will also contain a unique code (“Unique Code”) printed under the scratch. The customer will be prompted to enter the unique code on the web link (“Web link”) which appears after scanning the QR Code.

Step 3: The Customer have to enter their mobile number (mobile number will be OTP verified), their and valid email id. The customer has to also enter the name and the age of the child. (“Required Details”).

Step 4: Once the Required Details have been entered the Customer will be prompted to upload the front side of the Voucher clearly showing the Unique Code under the scratch(“Required Documents”). No claim will be entertained without the Required Details and Required Documents.

Step 5: The OTP verified mobile number will be considered as the registered mobile number (“Registered Mobile Number”) for this Promotion. Only one registration can be done with one registered mobile number every 30 days. The submission can be done till 31st October, 2024 only. On 31st October, 2024 the submission can be done till 5 PM only. The Customer cannot do a submission after the respective due date and time.

Step 6: After submission a Thank You message for purchasing the Signutra Product will appear on the screen of the Customer. The Customer will be prompted to select the type of cash code they prefer for the cashback (Phone Pe or Amazon Pay Cash Code). (Any one)

Step 7: TPPL will share the Selected Cash Code with the valid Customers on to their registered mobile number within 24-48 working hours from the date of submission of the Required Details and Documents on the web link. The Cash Code will be valid for 90 days only from the date of issuance. How the Customer can redeem the Cash Code is mentioned in Annexure A and Annexure B.

 

7. If the Customer does not fill the Required Details in the prescribed format, or does not upload the Required Documents they will be considered as invalid entries and will be disqualified from the Promotion and their Prize will be forfeited.

8. The Voucher or the Cash Code will not be revalidated or extended in case the Customer fails to redeem the same till the last date of redemption mentioned. TPPL or Company shall not be held responsible for any claims for the lost or lately used Vouchers or Cash Codes. Customer agrees to waive off right of redemption after the date of expiry of Scheme Period.

9. Last date to register your claim is 30 days from the date of purchase or 31st October, 2024 (whichever is earlier). On 31st October, 2024 the claims can be registered till 5 PM only. Any submission after the due date will not be considered valid and will not be entertained.

10. TPPL reserves the right to refuse to redeem the Vouchers if submitted by persons other than to whom they were issued or authorized. The scheme is not valid for the employees, family members of the employees or dealers/distributors/retailers/stores of the Company or TPPL, or employees/relatives of the dealers/distributors/retailers/ stores of the Company or TPPL, and TPPL will not be liable to honor such requests.

11. These Vouchers are non-transferable, non-negotiable and cannot be exchanged with any other gifts. The Company reserves the right to withdraw/suspend/cancel this offer without any prior notice and without assigning any reason thereof. No claims will be entertained by the Company in this regard.

12. Offer available on certain stock only. Stock without the Promotion offer will also be available across India. The offer may not be available on certain Promotion Products in certain pre-determined states of India.

13. This is the limited term Promotional offer only. Certain stock of the Signutra Products containing the Promotion offer may continue to be available even after the Scheme Period. However, the Customers understand and agree that they will not be permitted to participate in the Promotion after the expiry of the Scheme Period and further, agree not to raise any claim or complaint against the Company and/or TPPL or their agents in this respect.

14. By participating in this Promotion, the Customer accepts and agrees to abide by these terms and conditions of the Promotion. Please check the link <bit.ly link> for the detailed terms and conditions of this Promotion. The terms mentioned in the link also form the terms of this Promotion.

15. Entry and participation in this Promotion will be deemed as an unconditional and an unequivocal acceptance of these Terms, including any modifications, revisions and amendments thereto. The decisions of the Company and/or TPPL shall be final and binding on the Customers in all matters related to the Promotion.

16. By participating in this Promotion, the Customer hereby consent TPPL to collect, process, share such information with the Company and its affiliates for the purpose of this Promotion.

17. By participating in this Promotion, the Customer agrees to receive details and information about this Promotion on his/her mobile, through SMS or voice calls, during the tenure of the Promotion.

18. TPPL and/or the Company and other agents of the Company shall not be liable to perform any of their respective obligations under the Promotion or in respect of the Prizes where they are unable to do so as a result of circumstances beyond their control in the nature of fire, explosions, natural calamities, state emergency, riots, government restrictions or any other Force Majeure condition, etc., and shall not be liable to compensate the Customers in these circumstances.

19. TPPL and/or the Company accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, whether due to error, omission, alteration, tampering, unauthorized data hacking, deletion, theft, destruction, virus attack, transmission interruption, communications failure, hardware failure or otherwise. TPPL and/or the Company shall not liable for any consequences of user error including (without limitation) costs incurred. Illegible / incomplete / invalid / wrongly submitted claims will be rejected. Claims once rejected will not be accepted again in any manner. No new Vouchers will be issued against rejected claims.

20. If for any reason this Promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorized intervention, technical failures or any other causes beyond the reasonable control of Company and/or TPPL which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, Company and/or TPPL reserves the right in its sole discretion to cancel, terminate, modify or suspend the Promotion, subject to any written directions made under applicable State or Territory legislation.

21. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of Company and/or TPPL, including but not limited to technical difficulties, unauthorized intervention or fraud, Company and/or the TPPL reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to invalidate any Customer; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.

22. Caution: any attempt to deliberately damage the web link or the information on the web link, to cause malicious damage or interference with the normal functioning of the web link, or to otherwise undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, TPPL reserves the right to seek damages to the fullest extent permitted by law. If TPPL suffers loss or incurs any costs in connection with any breach of these Terms or any other legal obligation by any Customer, the Customer agrees to indemnify TPPL for those losses, damages and costs.

23. Any dispute arising out of the terms of this Promotion shall be subject to Arbitration under the Arbitration and Conciliation Act 1996 (the “said Act.”). One Arbitrator will be appointed by TPPL and the other by the Customer and the two Arbitrators so appointed shall in turn appoint presiding Arbitrator. The arbitration shall be held at Delhi and conducted in English as per the provisions of said Act.  The award passed by the arbitrators will be final and binding on both the TPPL and the Customer. All disputes arising out of this Promotion shall be subject to the jurisdiction of courts in New Delhi only.

24. TPPL is acting as an executing agency for this Promotion and holds no legal and financial liability on unclaimed Vouchers, Cash Codes, etc. beyond the applicable period of the Promotion.

25. If the Customer is dissatisfied with the Promotion or the Promotion Terms, his/her sole and exclusive remedy is to not participate in the Promotion.

26. The Customer agrees to indemnify, defend and hold harmless the Company, its directors, officers, employees, agents, affiliates and suppliers from any liability, loss, claim and expense (including reasonable legal fees) directly or indirectly related to (i) the Customers breach of this agreement, and (ii) the Customer providing Contents/details to the Company.

27. The Company reserves the absolute right to extend or terminate this Offer or alter the terms & conditions at any time.

28. Any costs associated with entering the Promotion, including accessing the Promotion website link, are the responsibility of participating Customers and Company shall not be responsible for any cost, expense or other liability whatsoever in relation to, arising from or connected with this Promotion.

29. If TPPL has already SMSed, the Customer’s Cash Code to the registered mobile number or email id of the Customer, TPPL will not re-send the Cash Code to any new or corrected phone number or email id nominated by the Customer.

30. This Promotion is not valid in conjunction with any other Promotion. In case of any conflict between terms and conditions printed on the Voucher and the website link, terms and conditions printed on website link shall prevail.

ANNEXURE A : TERMS TO REDEEM THE AMAZON PAY E-CODES

1. Visit https://www.amazon.in and Login

2. To add your Gift Code to your Amazon Pay Balance, Visit https://www.amazon.in/addgiftcard.

3. Alternatively, you can redeem by entering Gift Card code at "Amazon Pay- Add Gift Card" through app. If you are not an amazon customer yet, please sign up.

4. Start Shopping. Pay using Balance: Gift Card added to your Amazon Pay Balance will be available as payment method during check out. Any unused balance will remain in your Amazon account and can be used for subsequent purchases.

Validity

• Amazon Pay Gift Cards/Codes are valid for 90 days from the date of issuance.

• Receiver can apply the 14 digit alpha-numeric code (for e.g. 8U88-Y3B9CQ-60MKW) on amazon.in/addgiftcard and add the Amazon Pay balance in their account

• Amazon Pay Gift Cards/Codes cannot be refunded or returned

• Amazon Pay Gift cards/codes are redeemable across all products on Amazon except apps, certain global store products and other Amazon Pay gift cards

 

ANNEXURE B: TERMS TO REDEEM THE PHONEPE GIFT CARD/CASH CODE

1. If you have linked Gift Card balance in your account, the Gift Card balance will be automatically made available for payments towards eligible merchant transactions.

2. Gift Card balance is selected as a default mode for making the payment, you may choose to deselect this option if you do not wish to pay via Gift Card for a particular transaction.

3. In cases where you may have multiple Gift Cards linked to your account, PhonePe automatically picks the Gift Card balance which will expire the soonest.

 

 

TERMS OF USAGE OF PHONEPE

1. PhonePe Gift Card once bought cannot be cancelled.

2. PhonePe wallet balance or existing Gift Card balance cannot be used to purchase e-gift cards.

3. Any balance amount left on the used gift card can be reused within the validity period.

4. You are solely responsible for the safety and security of the e-gift cards. PhonePe is not responsible if the gift card details are lost, stolen or used without permission.

5. The gift cards cannot be replaced, refunded, revalidated or exchanged for cash.

6. PhonePe reserves the right to deny accepting any gift card if it suspects that there is duplicity of gift cards.

7. Any misuse of the gift card will result in cancellation of the gift card.

8. PhonePe is the final authority on the interpretation of these rules.

9. This is for individual use only. An individual user cannot utilize more than 50,000 worth of Gift cards in a month.

10. PhonePe shall not be responsible for any fraudulent purchases or services that might be availed by customers using the e-gift cards purchased through PhonePe.

11. PhonePe Gift cards can be used as payment option across all eligible PhonePe merchants and services.
